What Is OFCCP?
The Office of Federal Contract Compliance Programs is the federal agency within the Department of Labor responsible for enforcing the equal employment opportunity and affirmative action obligations that apply to organizations holding federal contracts and subcontracts. OFCCP enforces three primary statutes: Executive Order 11246, which prohibits employment discrimination on the basis of race, color, religion, sex, and national origin and requires affirmative action across those categories; Section 503 of the Rehabilitation Act, which requires affirmative action and prohibits discrimination against qualified individuals with disabilities; and the Vietnam Era Veterans' Readjustment Assistance Act, which requires affirmative action and prohibits discrimination against protected veterans. Every organization holding a federal contract or subcontract worth ten thousand dollars or more carries compliance obligations under these authorities, and the job posting dimension of those obligations is where the most consistently identified compliance gaps originate during formal OFCCP evaluations.

Who OFCCP Covers
OFCCP jurisdiction applies to federal contractors and subcontractors, not to every employer. The threshold for coverage is a federal contract or subcontract worth ten thousand dollars or more, which activates basic EEO obligations across the organization. For affirmative action program requirements including written affirmative action plans, the threshold is fifty thousand dollars or more in federal contract value with fifty or more employees. Federal contractor status flows through direct federal contracts with government agencies, subcontracts under federal prime contracts, federal supply schedule awards, federal grant agreements in some circumstances, and other federal funding relationships that create a contractual relationship with the federal government. Organizations frequently carry federal contractor status without recognizing it because the contract relationship that created the status was established through channels that did not communicate its OFCCP compliance implications to HR and compliance teams.
What OFCCP Requires
OFCCP compliance obligations cover several distinct areas of employment practice. Affirmative action program requirements obligate covered federal contractors to develop and maintain written affirmative action plans covering race, color, religion, sex, national origin, disability, and protected veteran status. Job posting requirements obligate covered federal contractors to post all suitable employment openings with state workforce agencies through the Employment Service Delivery System, carry required EEO and affirmative action compliance language on every posting across every channel, and distribute postings to veteran employment networks and disability employment channels as part of documented affirmative action outreach. Recordkeeping requirements obligate covered federal contractors to maintain records of hiring, compensation, promotion, termination, and job posting activity in a format that OFCCP investigators can evaluate during formal compliance reviews. And outreach requirements obligate covered federal contractors to make documented good faith efforts to recruit veterans, individuals with disabilities, minorities, and women through systematic outreach activity that goes beyond general commercial recruiting.
How OFCCP Enforces Compliance
OFCCP enforces its requirements through a compliance evaluation process that begins with a scheduling letter sent to the federal contractor. The scheduling letter requests the submission of the affirmative action plan and supporting data covering the current and recent compliance periods. Investigators review the submitted materials, request additional documentation, and may conduct an on-site review of the organization’s practices. The job posting compliance record that investigators request includes state workforce agency submission records with confirmed delivery documentation, compliance language records across distribution channels, and outreach distribution history covering the full review period. Federal contractors that cannot produce adequate documentation across those categories receive findings that require corrective action and may result in conciliation agreements, back pay requirements, and referral to the Department of Labor Solicitor’s office for enforcement action.
Why Job Posting Compliance Creates the Most Significant OFCCP Risk
Job posting compliance under OFCCP creates disproportionate audit risk relative to other compliance dimensions because it requires systematic execution on every job posting throughout the compliance period rather than policy development and plan documentation that occurs annually. An affirmative action plan that is technically deficient can be corrected before investigators arrive. A job posting record that reflects two years of ESDS submission failures, compliance language inconsistencies, and missing outreach distribution documentation cannot be retroactively corrected to satisfy the investigator’s request for records covering the period when the positions were posted. The documentation gap that results from manual compliance processes applied to job posting obligations at recruiting operation scale is the compliance gap that investigators find most consistently and pursue most thoroughly during formal OFCCP evaluations.
How dstribute.io Addresses OFCCP Job Posting Compliance
dstribute.io automates the job posting compliance requirements that OFCCP enforces across VEVRAA, Section 503, and Executive Order 11246. State workforce agency submissions through the Employment Service Delivery System execute automatically for every suitable opening based on job location, with confirmed delivery documented and retained for audit review. Compliance language including EEO taglines, VEVRAA affirmative action language, and Section 503 disability inquiry invitations applies uniformly across every distribution channel before any posting reaches any job board. Outreach distribution to veteran employment networks, disability employment channels, and minority professional associations reaches 2,000 job boards automatically on every posting. And audit documentation is built continuously at the position level across every location and every channel throughout the compliance period in a format designed for OFCCP investigator review. Federal contractors who implement dstribute.io report a 30 to 40 percent reduction in recruitment technology costs alongside VEVRAA posting compliance documentation that holds up under formal evaluation. See why federal contractors are choosing dstribute.io as their Circa posting alternative.
