OFCCP Recordkeeping Requirements

OFCCP recordkeeping requirements obligate covered federal contractors to maintain employment records across hiring, compensation, promotion, termination, and job posting activity in a format that investigators can evaluate during formal compliance reviews. The recordkeeping obligation is not satisfied by maintaining records that serve internal operational purposes. It is satisfied by maintaining records that address the specific documentation format, retention period, and organizational structure that OFCCP regulations require and that investigators request when scheduling letters arrive. Federal contractors who build compliance records for operational use rather than investigator review discover the gap between those two documentation purposes when they attempt to produce scheduling letter responses from records that were never designed to satisfy the investigator's request format.

What OFCCP Recordkeeping Covers

OFCCP recordkeeping requirements span three regulatory frameworks that each impose distinct documentation obligations on covered federal contractors. Executive Order 11246 recordkeeping requirements cover applicant flow data for every position during the review period, workforce composition data by job group and EEO category, compensation data supporting pay equity analysis, promotion and termination records with protected class information, and affirmative action plan documentation covering workforce analysis, availability analysis, placement goals, and program activity. Section 503 recordkeeping requirements cover disability self-identification data collected through the voluntary invitation process, job posting compliance records demonstrating disability outreach distribution on every suitable opening, accommodation request and resolution records, and utilization analysis documentation comparing workforce disability representation to the seven percent goal across each job group. VEVRAA recordkeeping requirements cover protected veteran self-identification data, job posting compliance records demonstrating state workforce agency submissions and veteran outreach distribution on every suitable opening, annual hiring benchmark documentation, and protected veteran hiring rate data comparing actual hiring outcomes to the established benchmark.

Job Posting Recordkeeping Requirements

Job posting recordkeeping is the OFCCP compliance documentation dimension that federal contractors most consistently fail to maintain at the depth investigators require, and the gap between what contractors maintain and what investigators request in this area is typically larger than the gap in any other recordkeeping category. The job posting record that investigators request covers four distinct documentation components for every suitable employment opening posted during the review period.

State workforce agency submission records must demonstrate that every suitable opening was listed with the correct state workforce agency in the Employment Service Delivery System within the required timeframe from when the position was posted, with confirmed delivery evidence retained for each submission. A log of portal access or submission attempts does not satisfy the confirmed delivery documentation standard. The record must show that the state agency received the submission, not merely that the submission was initiated.

Compliance language records must demonstrate that correct EEO, VEVRAA, and Section 503 compliance language appeared on postings across every distribution channel where postings were distributed during the review period. The compliance language record must reflect what appeared on postings as candidates saw them across each distribution channel, not merely what was entered in the ATS system before distribution.

Veteran outreach distribution records must demonstrate that every suitable opening was distributed to veteran employment networks, veteran service organization job boards, and state and local veteran employment representative programs with per-posting distribution evidence retained for each position. A commercial job board subscription without per-posting distribution records does not satisfy the systematic veteran outreach documentation standard.

Disability outreach distribution records must demonstrate that every suitable opening was distributed to disability employment networks, vocational rehabilitation program channels, and disability service organization referral sources with per-posting distribution evidence retained for each position. The same per-posting standard that applies to veteran outreach records applies to disability outreach records.

Retention Periods for OFCCP Records

OFCCP regulations establish minimum retention periods for different categories of employment records. Personnel and employment records including applications, interview notes, and hiring decisions must be retained for a minimum of two years for federal contractors with one hundred fifty or more employees holding contracts worth one hundred fifty thousand dollars or more, and for one year for smaller contractors. Affirmative action plan records must be retained for the duration of the plan year and for the subsequent period during which the plan is subject to review. Job posting compliance records including state workforce agency submission documentation, compliance language records, and outreach distribution records must be retained to cover the full compliance review period that investigators evaluate during formal compliance evaluations, which typically spans two years of posting activity. Federal contractors whose record retention practices reflect operational data retention schedules rather than OFCCP regulatory retention requirements frequently discover that the records investigators request for the full review period were purged before the scheduling letter arrived.

Applicant Flow Recordkeeping Requirements

Applicant flow records must cover every individual who expressed interest in employment during the review period across every position, including internet applicants who submitted applications through online application systems. For each applicant, the record must include the position applied for, the race and sex information provided through voluntary self-identification, the stage of the selection process the applicant reached, and the reason for disposition at each stage where the applicant was removed from consideration. Federal contractors whose applicant flow records reflect incomplete disposition codes, missing self-identification data due to incomplete collection processes, or inconsistent record formats across hiring managers and locations produce records that investigators identify as deficient under the applicant flow recordkeeping requirements that apply across Executive Order 11246, Section 503, and VEVRAA simultaneously.

Compensation Recordkeeping Requirements

Compensation records must support the pay equity analysis that covered federal contractors are required to conduct as part of their affirmative action program. The compensation record must cover base pay, total compensation components, pay grade or band, job title, job group, tenure, performance rating, and other factors that the organization uses in compensation decisions, along with the protected class information for each employee. Federal contractors whose compensation records reflect payroll system data organized for payroll processing rather than pay equity analysis organized by job group and protected class composition produce records that cannot support the compensation analysis that OFCCP investigators request when compensation disparity concerns arise during formal evaluations.

How dstribute.io Addresses Job Posting Recordkeeping Requirements

dstribute.io addresses the job posting recordkeeping requirements that federal contractors most consistently fail to satisfy at the depth investigators require. State workforce agency submission records with confirmed delivery documentation are generated automatically for every suitable opening and retained permanently in a format organized by position, location, state, and submission timestamp. Compliance language records are generated at the distribution layer for every posting across every channel before any posting reaches any job board, creating a language application record that reflects systematic execution rather than recruiter-level documentation. Veteran outreach distribution records are captured per-posting across 2,000 job boards including veteran employment networks for every suitable opening, building the systematic per-posting outreach documentation that VEVRAA posting compliance requires. Disability outreach distribution records are captured per-posting across disability employment networks and vocational rehabilitation channels for every suitable opening, building the systematic per-posting Section 503 outreach documentation that investigators require. And the complete audit support recordkeeping record is organized for investigator review and available on demand rather than reconstructed from operational data sources when a scheduling letter creates urgency. Federal contractors who implement dstribute.io report a 30 to 40 percent reduction in recruitment technology costs alongside job posting recordkeeping that addresses every dimension of the documentation standard investigators apply. See why federal contractors are choosing dstribute.io as their Circa posting alternative.

I am happy to experience that dstribute.io is more than expected. We received more candidates traffic from job postings in six weeks then we have with other boards in six months. .

We already have several hires less than month from going live. This has more than paid for itself and the team were so helpful in sorting out all the synchronization between our ATS/DB and how we do things internally. I highly recommend dstribute.io!
